NEW YORK, Jan. 6, 2014 — Bingham McCutchen LLP expanded its leading finance, global funds and structured transactions practices with the addition of derivatives partner Daniel Budofsky to the Investment Management Practice Group in New York.
Joining from Davis Polk, Budofsky advises banks, financial institutions, corporations, funds and asset managers on financial products in domestic and international transactions. He has worked on numerous derivatives and financing transactions, including fund derivatives, as well as a variety of complex structured products. In addition, Budofsky has acted as counsel to the Asset Management Group of the Securities Industry and Financial Markets Association in connection with derivatives reform and represented the International Swaps and Derivatives Association in connection with the drafting of the 2006 Fund Derivatives Definitions and the 2011 Equity Derivatives Definitions projects.
“Dan’s arrival to Bingham underscores the strength and caliber of our securities and commodities capabilities in key financial centers,” said Roger Joseph, co-head of Bingham’s Financial Services Area and investment management partner. “Dan brings a unique balance of regulatory and transactional experience in derivatives and will be an immediate asset to the firm in several of our leading practices and to clients.”
Timothy Burke, head of Bingham’s Financial Institutions Regulatory, Enforcement and Litigation Practice and co-leader of the Financial Services Area, specifically noted that “Dan’s experience complements our practice as well as Bingham’s broker-dealer, financial restructuring and insolvency practices.”
Budofsky will also play a key role as a member of Bingham’s Derivatives Group, noted Reed Auerbach, co-leader of Bingham’s Corporate Area and structured finance partner. “Dan’s arrival is ideal for our clients who are facing increased scrutiny from expanding derivatives regulations,” said Auerbach. “His perspective and experience in this space is exceptional. Dan will be working with our already-strong financial restructuring, white-collar and investment management practices and will instantly enhance our capabilities in handling trading, transactional, regulatory and enforcement issues for clients. It’s a great fit all around.”
Budofsky’s arrival also underscores Bingham’s continued investment in building upon the firm’s New York office capabilities for clients facing complex finance matters, noted New York office managing partner Anthony Carbone.
“New York remains a priority for our clients and Bingham,” said Carbone. “Dan’s reputation among his colleagues and clients speaks for itself. He will be a valuable partner in helping Bingham clients navigate the changing regulatory landscape nationally and globally.”
For Budofsky, Bingham’s reputation in the finance industry and its commitment to growing its investment management, broker-dealer and derivatives practices in key financial centers worldwide appealed to him. Most recently, Bingham added to its global funds capabilities in Tokyo with the arrival of a seven-lawyer team headed by Christopher Wells from White & Case as well as in London with the arrival of Thiha Tun from Herbert Smith. Bingham also enhanced its D.C. team in 2012 with the arrival of 12 investment management lawyers, including partners John McGuire, Thomas Harman and Chris Menconi from Morgan Lewis.
“I am very excited to join Bingham. Few, if any firms, have the vision, commitment and drive Bingham has in building such an integrated, client-centered team,” said Budofsky, noting that Bingham’s platform will enable him to expand his practice and benefit his clients.
Ranked by Chambers Global in the Band 1, USA category and by Chambers USA in the Band 1, Nationwide: Capital Markets: Derivatives category, Budofsky has also been recognized as a leading lawyer in IFLR 1000. He is the immediate past chair of the Derivatives and Structured Products Law Committee of the New York State Bar Association and a member of the Futures and Derivatives Regulations Committee of the New York City Bar.
