Garcia, Artigliere & Medby filed a lawsuit against skilled nursing facility BV General, Inc. (dba Leisure Glen Post Acute Care Center) and Healthcare Management Services, LLC for elder abuse, negligence, negligent hiring and supervision, and fraud on behalf of their client Bettye Price.
On July 15, 2014, Ms. Price underwent surgery at St. Vincent Medical Center to replace her right knee and a rod in her right leg. Eight days later, she was admitted to Leisure Glen Post Acute Care Center for rehabilitation to protect her from falls that would exacerbate her existing injury, the reason for her operation.
The lawsuit alleges that Leisure Glen Post Acute Care Center was aware that Ms. Price had a history of falls, severe urinary tract infections and a high propensity to wander. However, they failed to provide the adequate level of care, including assistance and monitoring when she walked. As a result, Ms. Price suffered a fracture to her right leg requiring an additional surgery, as well as preventable urinary tract infections.
“Ms. Price was expected to return home after rehabilitation,” said Stephen Garcia of Garcia, Artigliere & Medby. “Instead, she was put through a gauntlet of trials during her recovery, which left her with a more serious injury.
